Terms and Conditions

By using the services offered by Zen Ô Chalet, you agree to the following terms and conditions. Please read them carefully before using our services.

1. Definitions

  • Zen Ô Chalet: Refers to the company providing rental management, maintenance, and chalet rental services.

  • Client: Refers to any person or business using Zen Ô Chalet’s services.

  • Property: Refers to any real estate managed or rented by Zen Ô Chalet.

  • Tenant: Refers to any person booking and occupying a chalet through Zen Ô Chalet.

2. Scope of Services

Zen Ô Chalet offers the following services:

  • Rental Management: Analysis and recommendations for rental optimization, management of web platforms (Airbnb, VRBO, Monsieur Chalet, Chalet au Québec, Booking.com, Wechalet).

  • Maintenance and Upkeep: Housekeeping and outdoor maintenance services, preventive and corrective maintenance.

  • Chalet Rental: Booking management, guest services, and assistance.

All services are provided in accordance with the agreement made with the client or tenant, subject to availability and feasibility.

3. Zen Ô Chalet’s Commitments

  • Provide the described services professionally and within the agreed timeframe.

  • Protect clients' and tenants' personal data in accordance with our Privacy Policy.

  • Act as a trusted intermediary between owners, tenants, and service providers.

  • Maintain legally required insurance and hold an official CITQ classification for each property.

  • Deliver a clean and functional chalet with well-maintained amenities.

  • Offer assistance in case of issues (unjustified service calls may be billed).

4. Client and Tenant Commitments

Client (Owner):

  • Provide accurate and complete information about their property.

  • Comply with local laws and regulations regarding property rentals.

  • Perform basic property maintenance or inform Zen Ô Chalet of specific needs.

  • Exclusivity of management: For the entire duration of the contract, Zen Ô Chalet will be the sole rental manager of the property. The owner agrees not to entrust the rental management of the property to another company or to manage reservations and rentals personally.

Tenant:

  • Meet the minimum age requirement to book a chalet (requirements vary by chalet). A valid ID is required for confirmation at booking and check-in.

  • Review the chalet details and photos before booking and confirm satisfaction.

  • Treat the chalet, its contents, and neighbors with respect.

  • Vacate the property at the end of the stay without claiming occupancy rights.

  • Use the chalet exclusively for relaxation, vacations, or professional retreats. Subletting or commercial use is prohibited.

5. Financial Terms

Rates and Payments:

  • Service prices are communicated to the client or tenant before provision.

  • Web Platform Payments: All payments from web platforms will be collected by Zen Ô Chalet and redistributed to the owner monthly after deducting Zen Ô Chalet’s commission per the contract.

  • Additional Fees: Charges may apply for unforeseen services or urgent interventions.

Tenant Payment Policy:

  • Only credit cards are accepted for reservations.

  • Reservation Deposit: 50% of the total amount at booking (100% if booking is made less than 14 days before arrival).

  • Remaining Balance: 50% of the total amount due 14 days before arrival.

  • Security Deposit: Pre-authorization 24 to 48 hours before the stay.

6. Cancellation Policy

For Clients (Owners):

  • Any cancellation must be reported at least 14 days in advance to avoid cancellation fees.

For Tenants:

  • Cancellation requests must be sent in writing to info@zenochalet.ca.

  • More than 30 days before arrival: 10% cancellation fee of the total reservation amount (minimum $50).

  • Between 15 and 30 days before arrival: 50% cancellation fee of the total reservation amount.

  • Less than 14 days before arrival: 100% cancellation fee of the total reservation amount.

  • Non-Refundable Stays: Holidays, festive seasons, school breaks, construction holidays, and long-term rentals (31 nights or more).

  • In case of a no-show without prior notice, the full amount is due.

7. Liability and Limitations

Zen Ô Chalet commits to providing services with care and diligence but cannot be held responsible for:

  • Damage caused to the property by tenants.

  • Financial losses due to circumstances beyond its control (e.g., natural disasters, platform outages).

  • Legal compliance regarding tax declarations related to rentals.

  • Service interruptions beyond its control (electricity, water, telecommunications, etc.).

The tenant authorizes Zen Ô Chalet staff access to the chalet for inspections or necessary maintenance.

8. Termination of Services

  • Minimum Commitment: Upon contract signing, the client agrees to a minimum commitment of three months for property management. Early termination is not allowed.

  • Termination Notice: After the minimum period, either the client or Zen Ô Chalet may terminate the agreement with a written notice of two weeks before the end of the month. Any ongoing services will be billed until the effective termination date.

9. Non-Compliance with Terms

Failure to comply with these terms may result in the immediate expulsion of the tenant and their guests without refund, and legal action may be taken for damages if necessary.

10. Intellectual Property

All content on Zen Ô Chalet’s website, including text, images, logos, and management tools, is protected by intellectual property rights. Unauthorized reproduction or use is strictly prohibited.

11. Disputes and Governing Law

In case of disputes, Zen Ô Chalet will prioritize an amicable resolution. Otherwise, all disputes will be governed by the laws of the province of Québec, Canada.

12. Modifications to Terms and Conditions

Zen Ô Chalet reserves the right to modify these terms and conditions at any time. Clients and tenants will be informed of any significant changes.
